Abstract
Naprowadzanie administracyjne (administrative guidance) poprzez swoją elastyczność i zmienność oraz jako nieformalny, wszechobecny instrument kooperacji między japońskim biznesem i rządem stanowi jedną z najbardziej wyrafinowanych i najtrudniejszych barier polityki handlowej dla zagranicznych przedsiębiorstw, które podejmują działalność gospodarczą w Japonii. W artykule omówiono istotę naprowadzania administracyjnego, jego podstawowe założenia, warunki i sfery stosowania oraz stosunek japońskiego sądownictwa do naprowadzania administracyjnego.

In the perception of the citizens from the European Communities and from United States, government and big business in Japan are closely interwined. This perception extends to a feeling that even smaller businesses are controlled by government to an extent unknown in the West. Leading experts on Japanese legal antropology argue that such a perception is largely correct. The key to understanding what is meant by this lies in the nature of the phenomenon known as administrative guidance. Administrative guidance is possible in Japan partly because of the cultural attitude which the Japanese have towards government bureaucrats and partly because of the vagueness in the laws and the regulations made under them. Additional factors are the cultural disposition to prefer consensus rather than conflict and the general attitude of the Japanese to the law. For the companies from Europe and from United States administrative guidance is a very difficult non-tariff barrier on the Japanese market. (original abstract)
