- Abstract
- Omówiono podstawowe ograniczenia działalności bankowej w Polsce oraz instytucjonalne formy nadzoru bankowego.
The state in a meaningful way interferes with bank activity; Sejm - Polish House of Parliament, has through banking laws restricted ways of conducting banking activities and has defined internal relationship of a bank and its relationship with other banks in its area of operation. Some of the basic restrictions for bankers by lawmakers include: obligation to obtain a permission to open a bank, regulating operation activities through cautionary measures or sanctions, restriction of property rights of shareholders and stockholders, obligation to obtain permission to carry out corrective measure programs from Bank Supervising Commission, acquisition by Bank Supervising Commission partial rights of ownership and powers of a bank in time of liquidation and bank mergers as well as in time of declaration of bankruptcy, deprivation of creditors the rights of declaration of bankruptcy and putting the cost of dividing bankrupt's estate on the creditors.
