- Przedmiotem artykułu jest ustalenie wpływu śmierci lub zaginięcia osoby składającej wniosek przed organem rentowym o przyznanie świadczenia w postaci renty rodzinnej na możliwości uzyskania niezrealizowanej wypłaty przez członków jego rodziny. Wydawało się, że ustawodawca w sposób dostatecznie wyraźny wskazał krąg podmiotów uprawnionych do świadczenia, z którego nie mógł skorzystać wnioskodawca. Analiza art. 136 ustawy emerytalnej zdaje się jednak przeczyć temu twierdzeniu. Autorka dostrzega nieprecyzyjność terminu członkowie rodziny użytego w tym przepisie, co może utrudniać stosowanie prawa. (abstrakt oryginalny)
In case of death of the person entitled to the family pension after making a motion or in case of his death after gaining a decision, but before paying a rent, family rent from the Social Insurance Fund resorces is being paid back by the legislator for the special group of people. There are husband (wife) and children in this group with whom he (she) was staying in the household. In case of lack of these people the legislator is pointing out the other members of the family entitled to the rent or the people who were ensuring him the livelihood. The last mentioned group of people the author finds to be too large. In the article we can find also the problem of the disapperance of the person after making a motion about granting a family pension from the Social Insurance Fund resorces.
