Abstract
Autor omawia ekonomiczne uwarunkowania interwencji państwa w transport kolejowy w Polsce i Unii Europejskiej. Konkluduje, że władza publiczna powinna stopniowo wycofywać się z regulacji cen w transporcie kolejowym. Głównym zadaniem państwa jako regulatora powinno być aktywne usuwanie barier tworzonych przez niedawnych monopolistów w dostępie do tego rynku.

The author reviews economic determinants of the state intervention in the railway transport. The conclusions of the carried out analysis indicate that the public authorities should gradually withdraw from regulating the prices in railway transport. The total deregulation of the sector should not be immediate, as the disproportion in the market power between the hitherto state monopolists and new players is usually blatant. The main regulator's task of the state should be active reduction of the barriers erected by the hitherto monopolists hindering market access. However, such regulation should not be permanent. Its task lies in creating the situation where the total deregulation of the sector will be possible. Over the longer term, the main regulatory problem may become ensuring the adequate coordination between an infrastructural enterprise and the operator (the British experiences showed that vertical separation in railway transport results in worsened communication between particular elements of the system). It seems, that irrespective of the new regulation method, a complete withdrawal of the state from the ownership function in the operator's activity of railway transport should be postulated. It is justified not only by the reasons related to effectiveness; there is also the issue of the conflict of interests between the regulatory and ownership function of the public authorities which should be avoided. Moreover, the opening of the national markets to the foreign competition planned for the year 2007, makes necessary the establishment of the European super regulator of railway transport. It cannot be the recently appointed European Railway Agency (ERA), which is to serve only consulting and coordinative functions in relation to the national regulatory offices. It is particularly significant in the context of unavoidable consolidation of the sector and attempts at creating the "European champions" also in this area. However, the recently observed change towards economic protectionism in many European countries, makes highly probable blocking this consolidation in the name of the interests of"national champions". This is particularly dangerous, considering the fact that "natural" candidates for these positions will be hitherto national monopolists, which would stop or even turn back the sector liberalization also within particular countries. It would lead to a paradoxical situation when the first already carried out with great disturbances phase of the railway reform in the EU is stopped by the second phase. (original abstract)
