- Abstract
- W pierwszej części artykułu omówiono istotę i cele instytucji wspólnoty mieszkaniowej, oraz jej rodzaje. W części drugiej przedstawiono podstawę prawną działalności wspólnoty, obowiązki jej członków oraz opisano proces zarządzania nieruchomością.
This article describes the current situation of housing associations from the perspective of the mechanisms governing their establishment. The Law of 24 June 1994 on the Ownership of Premises restored the right of a citizen to possess a flat and imposed on the owners of premises new rights and obligations with regard to the maintenance of communal real estate. To this end, it established the institution of the housing association. At present, three categories of association can be distinguished: associations established on the basis of the resources of gminas, employers and new investors. The article discusses the principal legal aspects of the Law on the Ownership of Premises as well as the problems and limitations affecting the functioning of housing associations.
