Abstract
Criminal regulations in the Slovak Republic has changed approach of criminal capability to juventile offenders. Age qualification lowered from 15 years to 14 years. This is the reason of certain doubts, which concern with sanity of subject of crime. According provision of 338 Criminal Proceeding Act, in the case of juventile offender, who has less than 15 years in the time of crime, it is inevitable to observe, if this person was capable to recognise wrongfulness of act or if this person was capable command his actions. In the presence does not exist unified opinions in the question of expert. Expert proceeding is executed by experts in the branch of psychiatry or juventile psychology. In the comparision, in the conclusion of report, author deals with valid legal regulation of this issue in Czech Republic.(original abstract)
