- Abstract
- The paper deals with the role of the judicial branch in the separation of powers system. Author is aimed at changes in historical causes of the perception of the judiciary. In the early years of the development of the common law, courts played a considerable role in making law. But in the european-continental type of legal culture the courts' scope for making laws has been reduced in the last century, mainly due to the increased role of Parliament in law-making. However there is no doubt that the position of the judicial branch is renewed. Now, there is significant role of the judiciary in the law-making process. (original abstract)
