- Artykuł dotyczy problematyki zapisów umownych występujących w umowach dzierżaw nieruchomości gruntowych dla potrzeb powstanie farmy wiatrowej. Dokonano przeglądu praktyk występujących przy umowach dzierżaw terenów, w tym zapisów gwarantujących zakres używania i pobierania pożytków z przedmiotu umowy. Umowa dzierżawy terenu na czas określony tj. 29 lat zawierana jest w celu wybudowania na niej elektrowni wiatrowych. Inwestor (dzierżawca) podejmuje decyzje inwestycyjne na podstawie wstępnych pomiarów wiatru, które są podstawą do kalkulowania efektywności ekonomicznej inwestycji. (abstrakt oryginalny)
The paper set out aspects appeared in land lease agreements related to development wind farms. Performed market practice in lease agreements of lands and sentences guarantee scope of rights for consuming profits from the purpose of agreement. Lease contract is concluded for a terminated period (29 years) aimed at the development wind farm in the identified location. Investor (leaseholder) takes investment decisions basing on initial measurement campaign. Energy resources are assumptions for calculating economic rationale. (original abstract) - Accessibility
