- W artykule autor przedstawia zagadnienie dotyczące, określonej przepisami ustawy - Prawo geodezyjne i kartograficzne, normy prawnej ustalającej zasady dokonywania weryfikacji materiałów stanowiących wyniki prac geodezyjnych i kartograficznych przez organ administracji, do którego prace te zostały zgłoszone. Autor wskazuje na mieszany charakter tej czynności, jak również skutki procesowe z tego wynikające, w szczególności dotyczące terminu dokonania tej czynności, zakresu weryfikacji dokumentacji, zasad sporządzania protokołu, środków zwalczania bezczynności lub opieszałości organu w tym zakresie, a także możliwości upoważnienia przez właściwy organ osób uprawnionych do dokonania tych czynności i odpowiedzialności odszkodowawczej z tym związanej. In the article, the author presents an issue regarding a legal norm specified by the provisions of the Geodetic and Cartographic Law setting out the rules by which the administrative authority, to which the geodetic and cartographic work has been submitted, verifies the materials constituting the results of that work. The author refers to the mixed nature of this activity, as well as the procedural effects arising from this, in particular regarding the timing for performing this activity, the extent of verification of the documentation, the principles of preparing the protocol, the means of combating inactivity or tardiness of the authority in this respect, as well as the possibility of the competent authority authorizing people who are entitled to perform such activities and the related liability for damages.
