- Niniejszy artykuł poświęcony jest analizie regulacji prawnych w rolnictwie.
The present paper is devoted to the analysis of changes of regulations in legal relationships in agriculture from the point of view of the social situation of indi vidual farmers. The assumption has been adopted that the feeling of security as regards the future, professional stability and growth of a farmer's prestige are one of the conditions of intensifying, agricultural production. Although a decisive role in achieving this aim is first of all played by economic, socio-political and technical factors, law may be a stimulator of favourable changes expected by whole society. It was shown in the present paper that, beginning with 1982, a coherent, ho mogeneous legal system was formed, serving among others the strengthening of the social position of farmers. This system comprises the Constitution, civil code, the act of protecting agricultural and forest grounds, the act of consolidating the grounds, and the act of social ensurances for individual farmers and members of their families. The analysis of changes in the Constitution has been limited to discussing its guarantee function in relation to the permanence of individual family farms 'as an equal element of the socio-economic system. The basic principle of new agrarian policy of the State has been pointed at, it is the principle of the unity between Polish agriculture and equality of all sectors of agricultural economy. These chan ges have given the farmers large psychological comfort. It is from this angle that the civil code has been discussed. Moreover, modified regulations concerning the sales of agricultural estates have been indicated. They, too, are a sign of thé per manence of individual farms. In the act about protecting the agricultural, and forest grounds, regulations concerning assigning them for non-agricultural purposes and referring to the duty of utilizing the grounds for agricultural means have been indicated. New regulations protect the farmers against the powerful activity of State administration organs more than the previous ones, which strengthens the farmers' legal position. The act of consolidating the grounds was discussed from the point of view of democratization of proceedings and direct participation of involved farmers in it. While discussing the act of social insurances for individual farmers and mem bers of their families, it has been pointed out, for instance, that Poland has become the first country in the world where in the conditions of the prevalence of small producers' economy, farmers and membe'rs of their families have been included under a general system similar to the social insurance system for workers.(original abstract) - Accessibility
