- Abstract
- Celem artykułu jest przedstawienie całego przebiegu postępowania upadłościowego dotyczącego banków. Szczególną uwagę poświęcono regulacjom normatywnym zawartym w prawie bankowym. W węższym zakresie przedstawiono przebieg postępowania upadłościowego, a zwłaszcza poszczególne instytucje prawne wynikające z przepisów prawa upadłościowego.
In present-day economies, bankruptcy is a way of ensuring viability and eliminating unhealthy companies, including banks. However, the social and economic consequences of bank bankruptcy reach much further than they do in the case of other business categories. Naturally, specific laws must be enacted to regulate bank bankruptcy. Especially critical here are efforts to keep banks in operation, including efforts to restore their viability. The author discusses the legal aspects of bank bankruptcy. Here, the focus is placed especially on regulations which are specific and are specially designed for this category of businesses. In particular, a presentation is provided of differences in bankruptcy proceedings against banks, the special nature of reparation efforts, the liquidation and acquisition of banks, as well as the bankruptcy proceeding proper.(original abstract) - Accessibility
