- Abstract
- W artykule omówiono zawody, którym w Polsce i za granicą oferowane są ubezpieczenia odpowiedzialności cywilnej zawodowej. Scharakteryzowano odpowiedzialność cywilną, dzieląc ją na deliktową i kontraktową. Omówiono zakres, przedmiot i podmiot ubezpieczenia odpowiedzialności cywilnej zawodowej, wyłączenia w umowach ubezpieczenia OC zawodowej, zakres odpowiedzialności zakładu ubezpieczeń oraz zasady określania wysokości szkody i odszkodowania.
An exact definition of an insurance company's liability by virtue of insuring against job-related civil liability can undoubtedly be difficult. Above all, this is caused by a great variety of the possible solutions as regards defining the range of this insurance. Additionally, one can indicate other, equally important and frequently neglected, factors influencing the service provided, i.e. determination of the beginning and end of the insurance protection, guaeantee sum or guarantee sums, technical limitations of the liability. Finally, from a client;s point of view one of the most important elements influencing this liability seem to be the principles of assessing the amount of damage and indemnification. Only the analysis of al those elements makes it possible to exactly determine the liability incurred by an insurance company when signing a job-related civil liability agreement. This kind of insurance is a necessary instrument enabling a doctor, a tax advisor, a charactered accountant, a property expert, an architect and several others to perform their jobs.
