Abstrakt
Przedmiotem opracowania jest analiza problemu możliwości stosowania art. 81 i 82 TWE w międzynarodowym arbitrażu handlowym z uwzględnieniem czynników zarówno natury prawnej, jak i praktycznej. Podjęto próbę udowodnienia, że jakkolwiek stosowanie prawa konkurencji w sądownictwie polubownym stanowi kwestię niezwykle złożoną oraz budzącą wiele wątpliwości, jest to jednak warunek zapewnienia prawidłowego obrotu gospodarczego we Wspólnocie.

Years of incertitude have definitely passed - arbitrability of disputes relating to competition law is no longer put into question. Moreover, the judgement of the European Court of Justice in case Eco Swiss China Time Ltd v. Benetton Inter-national N. V. imposes on arbitrators an obligation to apply art. 81 and 82 of the EEC Treaty ex officio. Nevertheless, as far as the problem of interpretation is concerned, the ECJ explicitly rejected the possibility of giving preliminary rulings in response to questions submitted to it by arbitration tribunals. It should be noted that inappropriate application of Community competition law may result in a refusal of the execution of an arbitration award (according to Eco Swiss case, competition law constitutes a part of European public policy within the meaning of art. V of the New York Convention). In addition, the situation of arbitrator will get even more dificult under the new competition system brought about by the Council Regulation No 1/2003. It should be therefore stressed that arbitration tribunals will not be able to meet new challenges if the rules of cooperation between arbitrators, European Commission, national competition authorities and national courts are not created and suitable preventive and corrective mechanisms are not worked out.(original abstract)
