The article presents the essence and legal bases concerning free flow of capital existing in the European Union. A historical outline of the process of Poland's integration with the European Union has been introduced in detail as well as the stages of negotiations in the area of the free inflow of capital since 13 July 1999 when negotiation position was accepted by the Council of Ministers of the Republic of Poland, till the prersents temporary moment of closing them i.e. till 21 March 2002.
