- Przedstawiono cel i zakres dyrektywy o transgranicznej opiece zdrowotnej. Omówiono warunki transgranicznego świadczenia usług zdrowotnych. Zaprezentowano stanowisko rządu polskiego wobec dyrektywy.
On 19th January 2011, the European Parliament adopted its second reading of the cross-border healthcare directive, paving the way for a Council's ratification. The Directive, approved by the Council on 28 February 2011, will become effective in 2013. It respects and does not prejudice the freedom of each Member State to decide what type of healthcare it considers appropriate. As a general rule, patients will be allowed to receive healthcare in another Member State and be reimbursed up to the level of costs that would have been assumed by the Member State of affiliation, if this healthcare had been provided on its territory. Some issues relating to cross-border healthcare, in particular reimbursement of healthcare provided in a Member State other than that in which the recipient of the care is resident, have already been addressed by the Court of Justice. The Directive has raised many controversies, mainly due to expected financial burden for national budgets. The paper discusses provisions of the directive and their impact on the possibilities of treatment in another Member State as well as Poland's position towards the Directive.
