Abstrakt
Procedura konsultacji jest jedną z najstarszych formuł legislacyjnych w Unii Europejskiej (i Wspólnotach Europejskich). Po raz pierwszy pojawiła się w Traktatach Rzymskich z 25 marca 1957 r., które przewidywały jej zastosowanie w trzydziestu trzech artykułach (dwudziestu dwóch Traktatu ustanawiającego Europejską Wspólnotę Gospodarczą oraz jedenastu Traktatu ustanawiającego Europejską Wspólnotę Energii Atomowej). Do 2008 r. konsultacja była procedurą, w której przyjmowano najwięcej aktów prawnych, wyprzedzając współdecydowanie (obecnie zwykłą procedurę ustawodawczą - dalej ZPU), współpracę czy zgodę (wykres 1). Kres dominacji tej formuły nastąpił dopiero w wyniku postanowień Traktatu z Lizbony z 13 grudnia 2007 r., które, jak prognozują badacze, doprowadzą do sytuacji, iż około 90-95% całej legislacji będzie uchwalanych w ramach ZPU2. Konsultacja to również najbardziej specyficzna procedura legislacyjna UE. Jej przebieg nie jest zdefiniowany w żadnym artykule prawa pierwotnego; Traktaty ograniczają się wyłącznie do zawarcia w określonych przepisach obowiązku konsultacji danego projektu z Parlamentem Europejskim (PE), jednakże nie precyzują, jak należy ten termin rozumieć. W efekcie tryb tej procedury uformował się w ramach nieformalnej praktyki, przy istotnej roli orzecznictwa Trybunału Sprawiedliwości. (fragment tekstu)

Although consultation is a key legislative procedure, it is the subject of few studies in comparison to codecision/ordinary legislative procedure. This lacuna can be explained by a widespread, rationalist thesis shared by a majority of EU researchers that consultation is scientifi cally trivial as the European Parliament has limited power to give non-binding opinions for the Commission proposals; therefore, the main decision-maker is the Council that decides whether to incorporate or ignore the EP's amendments in the legislative act. But this leads to a paradoxical situation - we still do not know anything about the course and effects of procedure that generates the most legislation. The article is an attempt to fill the above-mentioned gap. By using the constructivist perspective, it shows that despite the formal limitations in consultation, the Parliament has many informal instruments which it can use to reinforce its demands successively. For example, it is able to affect the shape of the project at the preparatory phase, delay its opinion and, thus, block the entire legislative process, get Commission's support for its amendments in order to persuade the Council to incorporate its demands, and use argumentative and socialization effects during direct, secret talks in trialogues with the Council and the Commission. Therefore, under certain conditions, the Parliament can acquire dominant position in consultation. (original abstract)
