- Radykalna przebudowa polskiego systemu ubezpieczeń zainicjowana w lipcu 1990 r. ustawą o działalności ubezpieczeniowej, polegająca m.in. na definitywnym zniesieniu istniejącego od lat 50-tych państwowego monopolu ubezpieczeniowego oraz wprowadzeniu rynkowych zasad działania, musiała w sposób naturalny prowadzić do reaktywacji, znanej już w okresie międzywojennym, instytucji nadzoru ubezpieczeniowego. Nadzór nad rynkiem ubezpieczeniowym objął od samego początku swego istnienia dwa podstawowe elementy: ❑ badanie stanu faktycznego podmiotów nadzorowanych i porównywanie go ze stanem pożądanym określonym przepisami prawa (compliance); ❑ podejmowanie ingerencji w sferę praw i obowiązków podmiotów nadzorowanych w razie wystąpienia rozbieżności pomiędzy stanem faktycznym a stanem pożądanym, zakreślonym normami regulacyjnymi (enforcement). The article is devoted to the evolution of the forms and contents of the supervision of the Polish insurance market in 1990-2005. The first part presents premises of executing supervision by public authority. Author claims that it results from the fact that the supervision protects both public and private property. In the first ones, he includes market stability, security and transparency, while to the other - the protected interest of the insured person. The second part presents the international regulation architecture of the insurance market. The author pays special attention to the IAIS Insurance Core Principles which regulate the modern insurance order. The third part discusses the institutional evolution of the Polish supervision, while part four is dedicated to the evolution of the scope and the mode of performing the supervision of the market. The presented analysis proves that there is a constant development of regulation and supervision burden of the insurance entities. Both the width and the depth of supervisory penetration was increasing. Part five presents the internal structure of the supervision process and shows its complexity. Part six and the last is a conclusion of the issues being considered. The thesis is being formulated that the further development of the supervision practice will be under the predominant influence of the union solutions. (original abstract) - Dostępne w
